Liability

  $2,000,000 Liability Limits and $5,000,000 limits are available. Pays for Liability Imposed by law or assumed under contract for damages because of Bodily Injury or Property Damage.  Included in this policy:

  • Defense Costs Included

  • The rendering or the failure to render your Services

  • Paying premiums on appeal bonds required in defense of a suit

  • Includes tax and interest accruing after judgement upon you

  • Liability imposed for Medical Surgical relief to others imperative at the time of the accident.

  • Watercraft liability for boats owned, less than 8 meters long.

  • Intentional Force – For use of reasonable force for purpose of protecting persons or property

  • ·Wrongful entry or eviction

  • Invasion of the right of private occupancy

  • Discrimination

  • Mental anguish, shock, humiliation, harassment

  • False detention

  • Cross Liability Clause

  • Punitive and Compensatory awards:

Punitive Damages awards for both Compensatory and Punitive Damages. To further explain:

Compensatory damages are designed to repay a claimant for actual costs of securing needed medical care after
an injury, repairing damaged property, restoring any lost income and the like as well as to provide more
generalized compensation for physical and/or psychological pain and suffering.

Punitive damages are assessed against the wrongdoer as a punishment and are paid directly to the claimant.
The punitive damages are awarded in the cases of gross negligence. These cases can arise in medical and first
aid type law suits (or any others the court deems necessary). The limit for punitive damage is $100,000.

  •          Legal expense up to $ 50,000 per charge for Provincial inquests, tribunals inquests, hearings. Includes 100% of legal fees including disbursements incurred in defense of a charge laid for an alleged offense under the act.

  •          Non-owned automobile liability – Liability for damage to property of others or injury to others as a result of Volunteers using vehicles not owned by the SAR Unit.

  •          Advertisers Liability - $ 2,000,000.00 limit of coverage – Even if such suit is groundless, false, or fraudulent

  •          Tenants legal Liability, $ 2,000,000.00 all Locations. – Legal liability coverage for Property damage to surroundings you occupy as a tenant.

  Directors and Officers Liability Included

  •          $ 2 Million limits

  Protects you as a Board Member and your Board of Directors. Director and Officer coverage protects your personal assets as they   are, in fact, are vulnerable to legal suits (when you fulfill your duties as a Board Member). These suits may rise as a result of   actions or decisions made by you or your Board of Directors.

  Our program goes further. We include Association liability, which is a broader for of Director and Officer Liability Coverage.

  Insured:

  •          The association (named insured – SAR Unit), Directors and Officers, Employees and Trustees, Volunteers, Committee Members, and any other person acting on behalf of the Association or of an Officer of the Board of Directors of the Association. This is also extended to include spouses of the insured.

  Pays: On behalf of the

  •            ‘Insured’ for ‘loss’ sustained as a result of any claim arising from a ‘wrongful act’.

  Loss:

  •          Damages, Judgements, settlements and costs, charges and expenses.

  Claim:

  •          Any judicial or administrative proceeding initiated against any insured for damages or other relief.

  Wrongful Act:

  •          Any actual or alleged error or misstatement or misleading statement or act or omission or negligent breach of duty by any ‘insured’ or any other matter claimed against any ‘Insured arising out of the administration of the Association.

 Bereavement – Up to $1,500 for grief counselling sessions for your family

 Child Care – Up to $5,000/child/year, maximum of $25,000 for Child Care Expenses

 Education – Up to $7,500/child/year for higher education

 Spouse Employment Training – Up to $15,000 for higher education

 Living Benefits (insured person must suffer a covered loss):

 Temporary Total Disability Weekly Benefit:

            – $500/week for 26 weeks after 14 elimination period if employedd

            – $100/week for 26 weeks after 14 elimination period if not employeded

 Excess Medical – Up to $10,000 for covered medical services

 In-Hospital – $100 per day for 31 days if hospitalized for more than 3 days

 Family Transportation – up to $15,000 for transportation to injured insured person

 Home/Vehicle Adaptation – Up to $15,000 for home alterations or vehicle modifications

 Psychological Therapy – Up to $5,000 for psychological therapy

 Rehabilitation – Up to $15,000 if rehabilitation is required
